{"id":94,"date":"2021-03-29T14:24:54","date_gmt":"2021-03-29T14:24:54","guid":{"rendered":"https:\/\/asesoriacasvi.com\/?p=94"},"modified":"2021-05-26T09:18:25","modified_gmt":"2021-05-26T09:18:25","slug":"__trashed","status":"publish","type":"post","link":"https:\/\/asesoriacasvi.com\/index.php\/2021\/03\/29\/__trashed\/","title":{"rendered":"Cambios en el registro diario de la jornada laboral"},"content":{"rendered":"\n<div class=\"wp-block-media-text alignwide is-stacked-on-mobile is-vertically-aligned-center\"><figure class=\"wp-block-media-text__media\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1000\" height=\"666\" src=\"https:\/\/asesoriacasvi.com\/wp-content\/uploads\/2021\/03\/ley-registro-jornada-laboral-.jpeg\" alt=\"\" class=\"wp-image-384 size-full\" srcset=\"https:\/\/asesoriacasvi.com\/wp-content\/uploads\/2021\/03\/ley-registro-jornada-laboral-.jpeg 1000w, https:\/\/asesoriacasvi.com\/wp-content\/uploads\/2021\/03\/ley-registro-jornada-laboral--300x200.jpeg 300w, https:\/\/asesoriacasvi.com\/wp-content\/uploads\/2021\/03\/ley-registro-jornada-laboral--768x511.jpeg 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure><div class=\"wp-block-media-text__content\">\n<p style=\"font-size:32px\">Las obligaciones de registro diario de los trabajadores han cambiado nuevamente.<\/p>\n<\/div><\/div>\n\n\n\n<h1 class=\"wp-block-heading\" style=\"font-size:30px\">Antecedentes<\/h1>\n\n\n\n<p class=\"has-medium-font-size\">En este contexto, la Inspecci\u00f3n de Trabajo comenz\u00f3 a exigir el registro de jornada laboral diaria para los trabajadores a tiempo completo y parcial en 2016 (seg\u00fan sentencia de la Audiencia Nacional el 19 de febrero de 2016).<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Posteriormente, el Tribunal Supremo modific\u00f3 los est\u00e1ndares establecidos por la Audiencia Nacional en su sentencia de 23 de marzo de 2017, y restringi\u00f3 las obligaciones de registro diario a las horas extraordinarias y al trabajo a tiempo parcial, y se\u00f1al\u00f3 que \u201c<em>convendr\u00eda una reforma legislativa que clarificara la obligaci\u00f3n de llevar un registro horario<\/em> \u00ab.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Pues bien, esta reforma legislativa se llev\u00f3 a cabo con la promulgaci\u00f3n del Real Decreto Ley 8\/2019, que trata de las medidas de emergencia para la protecci\u00f3n social y la lucha contra la precariedad de la jornada laboral.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\" style=\"font-size:30px\">Actualizaciones<\/h1>\n\n\n\n<ul class=\"has-background has-medium-font-size wp-block-list\" style=\"background-color:#dae6ee\"><li>El gobierno puede extender o limitar las obligaciones de registro de tiempo de estos departamentos, cargos y categor\u00edas profesionales en base a las recomendaciones del Ministerio de Trabajo, Migraci\u00f3n y Seguridad Social y previa consulta a los sindicatos y organizaciones empresariales m\u00e1s representativas, cuyas caracter\u00edsticas as\u00ed lo requieran. <\/li><li>La empresa garantizar\u00e1 un registro diario de la jornada laboral, que deber\u00e1 incluir la hora concreta de inicio y finalizaci\u00f3n de la jornada laboral de cada trabajador. <\/li><li>El registro de la jornada laboral se organizar\u00e1 y registrar\u00e1 a trav\u00e9s de una organizaci\u00f3n colectiva o convenio de empresa, en caso contrario lo determinar\u00e1 el empleador previa consulta con el representante legal de los trabajadores de la empresa.<\/li><li>La empresa mantendr\u00e1 registros durante 4 a\u00f1os. <\/li><\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Con todo, desde el 12 de mayo de 2019 (fecha de vigencia de esta medida), todas las empresas deben registrar la jornada todos los d\u00edas, incluyendo la hora de entrada y salida de cada trabajador (independientemente de su jornada). <\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Sistemas de registro diario<\/h1>\n\n\n\n<p class=\"has-medium-font-size\">Se puede observar que aparte de registrar la hora de inicio y finalizaci\u00f3n de la jornada y negociar con los representantes de antemano (si no existe ninguna disposici\u00f3n en la negociaci\u00f3n colectiva o convenio de empresa), no existe un sistema o m\u00e9todo de registro obligatorio. <\/p>\n\n\n\n<p class=\"has-medium-font-size\">Por lo tanto, de acuerdo con los est\u00e1ndares de la Inspecci\u00f3n de Trabajo, las empresas son libres de elegir el tipo de sistema de registro, siempre que pueda garantizar la confiabilidad e inmutabilidad de los datos, y al menos reflejar la hora de inicio y finalizaci\u00f3n. diario.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">De esta manera, se puede realizar tanto un sistema manual (como un reloj) como un registro de estado autom\u00e1tico. Tambi\u00e9n puede utilizar hojas de trabajo firmadas por el personal que suelen utilizar la mayor\u00eda de las peque\u00f1as y medianas empresas, o utilizar aplicaciones inform\u00e1ticas instaladas en el equipo personal o profesional del personal. <\/p>\n\n\n\n<figure class=\"wp-block-pullquote is-style-solid-color\"><blockquote><p>Nota: Por lo tanto, mientras la Inspecci\u00f3n de Trabajo pueda verificar dichos registros, da libertad para realizar los registros diarios, siempre que no exista obligaci\u00f3n legal o convencional de estipular alg\u00fan sistema espec\u00edfico o uso espec\u00edfico con requisitos especiales. <\/p><\/blockquote><\/figure>\n\n\n\n<h1 class=\"wp-block-heading\" style=\"font-size:30px\">Las peculiaridades de ciertas ocupaciones. <\/h1>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:25px\">Empresas o particulares que prestan servicios a distancia<\/h2>\n\n\n\n<p class=\"has-medium-font-size\">En este tipo de trabajo, un sistema de registro consistente en papel firmado por los trabajadores todos los d\u00edas puede no ser el sistema m\u00e1s efectivo para cumplir con las obligaciones de registro diario (aunque s\u00ed lo es), porque puede resultar en una falta de control o control si los trabajadores lo hacen. No participar Informaci\u00f3n perdida.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">En estos casos, puede ser m\u00e1s conveniente utilizar sistemas digitales instalados en dispositivos m\u00f3viles entregados a los empleados. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"font-size:25px\">Guardias del personal<\/h2>\n\n\n\n<p class=\"has-medium-font-size\">Una vez que algunos trabajadores han finalizado su trabajo habitual, pueden estar en \u00abstandby\u00bb en cualquier momento, por si acaso ocurriera alguna situaci\u00f3n que pudiera requerir su intervenci\u00f3n. <\/p>\n\n\n\n<p class=\"has-medium-font-size\">En estos puestos de trabajo, la obligaci\u00f3n de realizar registros diarios continuar\u00e1 incluso fuera del horario laboral normal (que se considerar\u00e1 como horas extraordinarias) y fuera del lugar de trabajo.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Las obligaciones de registro diario de los trabajadores han cambiado nuevamente.
